Reservation Terms & Conditions

These reservation conditions (the “Reservation Conditions”) are between FunLifestyleVacations.com and the guest(s) who reserves a Lifestyle Holidays Vacation Club (“Lifestyle”) Accommodation (the “Accommodation”). References to “you” or “your” are references to the person making the reservation (“Reservation”) and all members of the vacation “party.”

Any reservation is subject to the conditions below. These Reservation Conditions form the basis of your contract with us so please read them carefully. Nothing in these Reservation Conditions affects your normal statutory rights.

1. Making your Reservation

There are 3 options to reserve an Accommodation with us. Vacation Packages (‘option 1”), Online Booking (‘option 2”), and Reservation Request (‘option 3”).

All options except option 1 will allow you to make a reservation by paying a 50% deposit (the “Initial Deposit”). The reminder amount (the “Reminder Balance”) will be due 45 days before your check-in date. If your check-in date is within 45 days at the time of reservation, a full payment must be made.

Once the Initial Deposit or full rental payment has been received, we will send your reservation to Lifestyle Holidays Vacation Club. You will receive an email that Lifestyle accepts your reservation. Wait to book your flights until the resort has accepted your reservation.

You will receive a Confirmation soon after your reservation has been accepted. The contract between us will only be formed when you receive the confirmation from Lifestyle Holidays Vacation Club. It is subject to these Reservation Conditions.

You should carefully check the details of your Invoice before making a payment, as well as the Confirmation email and inform us immediately of any errors or omissions.

2. Paying for your reservation

Where you have only paid an Initial Deposit, you are required to send to us your payment for the Reminder Balance no later than 45 days prior to the arrival date (the “Arrival Date”) specified in your reservation. If you fail to make a payment due to us in full and on time we may treat your Reservation as cancelled by you.

Infants under 3 years old don’t pay. Children from 3 to 11 years old pay 50%. Kids 12 years old or older pay as adults.

Our preferred method of payment is Paypal which allows users to conveniently pay using major credit cards and U.S. bank accounts at no extra cost. A Paypal account is not required to make a payment, however creating one is recommended for faster checkout next time.

We also accept certified checks and money orders, if you prefer using this payment method, you should use the [Reservation Request Form] and inform us of this choice. Please note this payment method requires full payment up front. We will send you the pertinent payment info on your confirmation email.

3. If you modify your Reservation

If you need to modify your Reservation you must write to us or email us as soon as possible. A modification will not take effect until we receive confirmation in writing or via email from you.

Once your reservation is confirmed, you can make date changes with 3 months’ notice prior to your arrival date. Usually Lifestyle Holidays Vacation Club can accept alterations of 2-3 days to accommodate flight changes. Of course, all alterations are subject to availability. Change fees may apply and will vary depending on the proximity the date of arrival.

4. If you cancel your Reservation

If you need to cancel your Reservation you must write to us or email us as soon as possible. A cancellation will not take effect until we receive confirmation in writing or via email from you.

▣ Reservations cancelled thirty (45) days or more prior to the date of arrival will incur a 20% charge from the total reservation amount.

▣ Reservations cancelled between thirty (30) to forty five (45) days or more prior to the date of arrival will incur a 50% charge from the total reservation amount.

▣ Reservations cancelled less than thirty (30) prior to the date of arrival will forfeit any and all amounts paid in its entirety.

Please note that there are no refunds for early check-outs and “no shows”.

5. If Lifestyle Holidays Vacation Club relocates you to alternative Accommodations

We would not expect to have to make any changes to your reservation, but sometimes problems occur and Lifestyle Holidays Vacation Club does have to relocate you to alternative Accommodations.

If this does happen, we will contact you as soon as is reasonably practical and inform you of the relocation. If Lifestyle Holidays Vacation Club relocates you to alternative Accommodations, you will not be charged any change fees and any refunds will be processed depending on the accommodation change. However, we will not be liable to refund to any fees you may have paid to any third party in connection with your vacation (including, without limitation, fees for travel, entertainment, activities or insurance).

6. The Accommodation

You can arrive at the Accommodation after the time specified by us on the Arrival Date for your holiday and you must leave by the time specified by us on the departure date on your confirmation.

If your arrival will be delayed, you must contact the Transportation Department so that alternative arrangements can be made. The contact details are given on the confirmation. If you fail to do so you may not be able to gain access to the Accommodation. If you fail to arrive by midnight on your Arrival Date and you do not advise the resort of your anticipated late arrival, the resort and we may treat the reservation as having been cancelled by you. Please see your confirmation.

7. Your obligations

You agree to comply with the regulations set out at the resort provided to you and any other regulations reasonably specified by us from time to time and ensure that they are observed by all members of your party. You agree to take good care of and leave the Accommodation and the furnishings, including items such as kitchen equipment, bath or beach towels or pool equipment.

You agree not to cause any damage to the walls, doors, windows or any other part of the resort nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighboring properties.

You agree to take all necessary steps to safeguard your personal property.

You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). We are not responsible for any liability incurred in case you fail to obtain this coverage.

You cannot allow more people to stay at the resort than expressly authorized, nor can you significantly change the makeup of the party during your stay in the Accommodation, nor can you take your pet into the Accommodation. If you do so, the Resort can refuse your check in or can require you to leave it.

We will treat any of these circumstances as a cancellation of the Reservation by you and we will be under no obligation to refund you for fees already paid to us in those circumstances. Any refund will be at our sole discretion.

You agree to allow us or any representative of ours access to your Accommodation at any reasonable time during your stay for the purpose of essential repairs or in an emergency.

8. Complaints

Every effort has been made to ensure that you have an enjoyable and memorable vacation. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible.

It is essential that you contact VIP Services if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless they are promptly notified. Discussion of any criticisms with them while you are in residence at the Resort will usually enable any shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or cooling of the Accommodation) cannot possibly be investigated unless registered while you are in residence.

If any complaint cannot be resolved during your vacation, you must write to us with full details within 28 days of the end of it.

9. Our liability

Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to the total fees you have paid for the Reservation.

We will not be liable for any losses that are not a foreseeable consequence of us breaking these Reservation Conditions. Losses are foreseeable when you and we could predict them at the time your Reservation is confirmed.

Your Reservation is made as a consumer for the purpose of a vacation and you acknowledge that we will not be liable for any business losses suffered or incurred by you.

We will not be liable to you for any personal injury or damage to or loss of personal property, except where the injury, damage or loss is caused by our negligence.

This does not exclude or limit in any way our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability.

10. Law

The contract between you and us is governed by the law of the State of Maryland and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of the State of Maryland.

11. General

Members of Lifestyle Holidays Vacation Club are not allowed to book as guests through FunLifestyleVacations.com to avoid any conflict of interest with their existing membership.

You may not transfer your Reservation or any rights and responsibilities under these Reservation Conditions to any other person, without our prior written consent.

If at any time any part of these Reservation Conditions is held to be unenforceable for any reason under any applicable law, that part will be deemed omitted and the enforceability of the remaining parts will not in any way be affected by that omission.

These Reservation Terms & Conditions and Lifestyle Holidays Vacation Club Confirmation contain the entire agreement between you and us regarding the Reservation and supersedes any previous agreements, arrangements or discussions.
